Background on the Mortgage Clause on a Homeowners Insurance Policy:

If you have a mortgage, the lender is listed on your home insurance policy under what is known as the Mortgage Clause.

According to Investopedia, a Mortgage Clause is “a clause in a property insurance policy which states that the property insurance company will pay out any claims to both the mortgagor (mortgage holder) and the mortgagee (mortgage lender). ” Basically it lists the mortgage company on the insurance policy. ” Mortgagee clauses essentially serve the purpose of making sure that the parties who give mortgage loans will not suffer major losses if something happens to the property that the mortgage is for. “

This sounds simple and it is, until you go to buy a house or refinance a house. This can also happen even when your mortgage policy starts getting serviced by a different company. An entire industry, unbeknownst to most consumers exists to solve the issue of the proper mortgage company being listed on your home policy.

How to Change the Mortgage Company Listed in a Homeowners Insurance Policy:

Most consumers will first become aware of this problem either when they go to buy a house, refinance, or they receive a letter. Sometimes the letter from the lender is somewhat aggressive.

In order to solve the process – you begin by engaging your mortgage people who will contact either your insurer or your agent. Sometimes it can be helpful to supply your mortgage person with the name of your insurance agent.

If you receive a letter send it to your insurance agent, or insurer via fax or email. Sometimes you can even just snap a photo of it with your smart phone camera.

NOTE: Mortgage Companies dislike emailing any information. Therefore they have a tendency to only want to use fax machines.

Simple, send us an email or a fax. Knowing that most mortgage companies refuse to use email, fax it direct to us at: 415-324-4184. You may of course also Mail the information to us at PO Box 585 Mill Valley, CA 94941.

Please DO NOT call us and leave us a voicemail requesting that we call you back. Especially if it is a call center and you only leave us a reference number. However, If you have a direct phone line, you are welcome to leave a message.

All Mortgage Change Requests Should Include the Following Information:

  • Legal Bank Name
  • Bank Address
  • Loan Number
  • Bank Fax Number
  • Bank Phone Number
  • Placement of the Note (Primary, Secondary)
  • Type of Note
  • Any specifics as it relates to other notes (Remove, Update)
  • Consumer Authorization

Skipping any of these items can delay processing of your request.
